This Online Store Policy governs the terms and conditions for the online store including sales, transactions and returns. By reading this you agree to be bound by these terms and conditions.
Terms of Sale
By placing an order on Gnome Treasure ("We"), you are offering to purchase a product on and are subject to the following terms and conditions.
Buyers must be over 18 years of age or the age of consent in your country.
All purchases go through PayPal, which processes credit or debit cards and payments. If problems with payments or transactions arise, We cannot be held accountable, as this would be an issue with PayPal and We would advise you contact them.
Payment receipts will be displayed as RPG Maker Times.
We retain the right to refuse any purchases made by you. If your order is accepted, you will receive a confirmation email either by third party payment processors (specifically PayPal) or in some cases by Gnome Treasure. Where such a contract is made with a third party, Gnome Treasure is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you.
When placing an order, you undertake that all details you provide are true and accurate, that you are an authorized user of the credit or debit card used to place your order, that there are sufficient funds to cover the cost of the products, and that you will not chargeback to abuse receiving the products.
All prices are in USD, but the cost of the products due to currency exchange may be different or may fluctuate. All prices advertised are subject to such changes and may increase or decrease without notice.
Purchasing Contract
When you place an order, and commit to the purchase of digital products or downloadable content, you will receive an acknowledgement email confirming receipt of your order. This email will only be for confirmation through PayPal (or other third party payment processors as they become available).
Once payment has been confirmed, orders will be marked as "Completed" and a downloadable link will become available. You will be notified via email of order completion. Please allow up to 3 days for orders to be processed.
Links to digital products and downloadable content will be available after the transaction has been successful for a period of 14 days. If, for whatever reason, after the expiry period you need additional copies of your digital products or downloadable content, you can request additional copies via the Contact Form, including name/user ID and email address, and the product name(s) and transaction or PayPal receipt number(s).
Only those products listed on the PayPal website and/or in the confirmation email sent at the time of purchase will be included in this contract.
You agree upon purchase that you will not share the provided link(s) or file(s); you agree that you will not sell, resell, or repurpose the file(s) or include them in other compilations or bundles; and you agree that you will only use the file(s) in the projects for which it/they has/have been designed.
Refunds
You can cancel your order at any time during the ordering process.
Refunds can only be issued within a 14 day cancellation period provided that no digital product or downloadable content has been downloaded and saved to your hard drive.
You cannot request a refund if the delivery of the digital product or downloadable content has been confirmed or initiated upon your request. In that instance, you thereby acknowledge that you lose your cancellation right.
However, if payments cannot be processed within 21 days (i.e. payments cannot be processed via PayPal), or if there is an error on Gnome Treasure’s part, We will manually issue a refund using the PayPal email you provided and offer an alternative, direct method of payment and/or download link. Refunds usually take 3-5 days.
Pricing and Availability
Whilst We make every effort to ensure that all details, descriptions and prices appearing on Gnome Treasure are accurate, errors may still occur. If we discover an error in the price of any products that you have ordered, We will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or providing you with store credit for the deficit amount in the event that a price increase occurs at the time of your purchase.
If We are unable to contact you or you have not responded within 21 days of receiving the email, We will treat the order as accepted and payment will be processed.
Additional charges may apply for taxes or currency conversion; such additional charges will be clearly displayed where applicable and indicated in the Total Cost.
Payment
All payments go through PayPal, acting as a secure third party for purchases and transactions. Upon receiving your order, PayPal carries out a standard authorization check on your PayPal account or credit or debit card information to ensure there are sufficient funds to fulfill the transaction. Your PayPal account or card will be debited upon authorization and the monies received therefrom, including additional fees that may be incurred, shall be treated as a deposit against the value of the products you wish to purchase.
A unique link will be provided for digital products and downloadable content once payment is authorized and confirmed and the transaction is complete. You cannot share this link with third parties or propagate the link on external websites.

Fees and VAT
Prices listed on Gnome Treasure are in US Dollars. VAT is included in the price; however, some countries may apply additional fees, including individual VAT rates and taxes. Currency conversion fees may also apply in certain instances.
Disclaimer of Liability
The material and content on Gnome Treasure, including but not limited to its products, is provided without any guarantees, conditions or warranties as to its accuracy.
Unless expressly stated to the contrary to the fullest extent permitted by law, Gnome Treasure hereby expressly exclude all conditions, warranties and other terms which might otherwise be impled by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to reputation or goodwill, or the cost of procurement of subsitute products, arising out of or related to the use, inability to use, performance or failures on the Gnome Treasure website and any materials, content and products thereone, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise.

Indemnity
You agree to indemnify, defend and hold harmless Gnome Treasure, its owners, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of the Gnome Treasure website or your breach of all the Terms and Conditions present hereon.
